Consultation on the Licensing Draft Cumulative

Impact Policy Statement

 

The Council in its capacity as Licensing Authority invites your views on the attached draft Cumulative Impact Policy. The policy is proposed to cover a specific area, the Fulham Town Centre Area, as identified in the draft policy. The Council is considering whether to adopt the policy and will take all relevant representations into account in reaching its decision.

Over the last few years, the Council has become aware that, due to the popularity of the location, the increase in the number of venues and longer trading hours, local residents, businesses and visitors within the Fulham Town Centre Area are being affected by crime and disorder and public nuisance on a regular basis.

Following an earlier consultation with residents, businesses and responsible authorities the Council is of the opinion that however tightly controlled and well-run individual premises are in the area, the number of premises in one location is resulting in issues such as excessive late night noise, rowdiness, intimidation, litter and criminal damage, all of which have had a detrimental effect on the local area.

As you may be aware, the Council is under a duty to make revisions to its statement of licensing policy at such times as it considers necessary and appropriate. Following an extensive evidence gathering period the Council considers it may well be necessary and appropriate to introduce a special policy in relation to cumulative impact.

The effect of adopting such a policy would be to create a rebuttable presumption that applications for new premises licences or club premises certificates or variations that are likely to add to the existing cumulative impact will normally be refused, where a relevant representation has been made, unless the applicant can demonstrate that there will be no negative cumulative impact on one or more of the licensing objectives.
